1. Eligibility. The Elmo Live! Giveaway (the "Sweepstakes") is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry. Employees, agents, officers, contractors, trustees and directors of Sesame Workshop ("Sponsor"), Kintera, Inc. and Mattel, Inc., and each of their respective parents, subsidiaries, affiliates, and advertising and promotion agencies, and members of their immediate family (parent, child, spouse, sibling and their respective spouses, regardless of where they reside), and members of the household, whether or not related, of any of the foregoing are not eligible to enter or win. By participating, each entrant agrees to abide by these Official Rules and all decisions of Sponsor, which shall be final and binding. All prize awards are subject to verification of eligibility and compliance with the terms of these Official Rules. Void in Puerto Rico and other U.S. territories and possessions and where prohibited by law. The Sweepstakes is subject to all applicable federal, state and local laws and regulations.
2. Entry Period. The Sweepstakes begins on November 24, 2008 at 12:00:01 AM Eastern Time ("ET") and ends on December 14, 2008 at 11:59:59 PM ET ("Entry Period").
3. How to Enter. To enter, visit www.sesameworkhop.org/elmolive ("Web Site") during the Entry Period and follow the instructions to complete and submit an entry form containing true and correct information. A completed entry must include entrant's full name, entrant's valid e-mail address, entrant's valid and complete postal address, and the name of the person to whom the entrant will give the prize as a gift if such entrant is deemed a winner. P.O. boxes are not permitted. If the gift recipient is a minor, and the entrant is not the parent or legal guardian of the gift recipient, entrant must obtain the permission of the gift recipient's parent or legal guardian to submit the gift recipient's name. Information regarding the gift recipients will be used only to fulfill Prizes. All entries must be submitted by 11:59:59 PM ET on December 14, 2008 to be eligible. Limit one (1) entry per person and per postal address for the entire Entry Period. Entries received from any person or postal address in excess of the stated limitation will be void. Entries generated by script, macro or other automated means and entries by any means that subvert the entry process will be void. All entries become property of the Sponsor and will not be returned.
4. Prizes (30). An "Elmo Live" plush doll. Limit of one (1) prize per household. The Approximate Retail Value ("ARV") of each prize is $60. The total ARV of all prizes is $1,800. Winners are responsible for all federal, state and local taxes and any other costs and expenses associated with prize acceptance and use not specified herein as being provided. Prizes are awarded "as is" with no warranty or guarantee, whether express or implied by Sponsor, except for any limited warranty that may be provided by the manufacturer of the prize. No transfer, cash redemption or substitution of prizes is permitted, except by Sponsor, which reserves the right to substitute a prize with one of comparable or greater value, at its sole discretion. Prizes will be mailed to gift recipients, as opposed to winners. All prize details are at Sponsor's sole discretion.
5. Selection and Notification of Winners. The Sponsor will randomly select potential winners on or about December 15, 2008 from eligible entries received during the Entry Period. Odds of winning depend on the number of eligible entries received. Potential winners will be informed by email and must satisfactorily provide all requested information (including name and complete postal address of the gift recipient; gift message is optional) by email within two (2) days of date of notification. If for any reason a potential winner is ineligible or fails to respond to the email notification by the specified time period, if Sponsor is unable to contact a potential winner within a reasonable time period, if a potential winner fails to fully comply with these Official Rules, or if a prize notification or prize is undeliverable, the prize will be forfeited and Sponsor will award the prize to an alternate winner.
6. Privacy Policy. The information collected through this Sweepstakes is subject to the sesameworkshop.org Privacy Policy and will be used in accordance with such Privacy Policy.
7. General Conditions. Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered or garbled entries or email; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), web site, or other connections; or for unavailability, inaccessibility, miscommunications or other failure of computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties that may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement and/or sending of the prizes or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the Web Site. Sponsor reserves the right in its sole discretion to disqualify any individual found by Sponsor in its sole discretion to have interfered with or tampered with the normal operation of the Sweepstakes or the Web Site or to have otherwise violated the Official Rules and void all associated entries. Sponsor reserves the right in its sole discretion to cancel, suspend or modify the Sweepstakes if virus, bugs, worms or any abuse, technical problems, unauthorized intervention or other causes impair the integrity, administration or proper play of the Sweepstakes. In the event of cancellation, Sponsor reserves the right to select the winners from among all eligible, non-suspect entries received prior to such cancellation. Each entrant agrees to release and hold harmless Sponsor, Kintera, Inc. and Mattel, Inc., and all of their respective parents, subsidiaries, affiliates, and advertising and promotion agencies and all of their respective contractors, trustees, directors, officers, employees and agents (collectively, the "Released Parties") from and against any liability, damage, or claim caused directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or possession, use, or misuse of any prize including, but not limited to, any personal injury or loss or damage to property. Each winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his or her name, address (city and state), photograph, voice and/or other likeness for advertising, trade and promotional purposes without further compensation, in any and all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
8. List of Winners. For a list of the winners' names (available after January 31, 2009), please send a self-addressed, stamped envelope to: Elmo Live! Giveaway Winners' List, Sesame Workshop, One Lincoln Plaza, New York, New York 10023, by March 31, 2009.
